Commercial Disputes and Debt Recovery in Russia

Assess a claim, respond to a demand or pursue the Russian legal stages of a commercial dispute. The strength of the evidence, the available procedure and enforcement prospects need separate consideration.

When to contact us

  • A Russian counterparty has not paid under a contract.
  • Your business has received a claim.
  • Negotiations have stalled and proceedings are being considered.
  • A judgment needs enforcement in Russia.

What the engagement may include

  • Analysis of claims, contracts and evidence.
  • Pre-action correspondence and settlement negotiations.
  • Preparation of court documents and representation.
  • Support at the enforcement stage; assessment of the Russian recognition or enforcement of a foreign decision where applicable.

What you receive

A legal position and strategy, documents and representation for the agreed stages. Procedural steps, evidence gaps and recovery risks are discussed before deciding how to proceed.

A favourable judgment does not guarantee receipt of money. Recognition of a foreign decision is not automatic and requires assessment of the particular legal basis and circumstances.

Getting started

First identify the parties’ roles, the Russian connection and any deadline without sending confidential documents. After the conflict check, the scope, documents, timetable and fee are agreed. Advice is tied to the facts and materials supplied.

  1. Send a brief first enquiry and identify the Russian issue.
  2. We check whether the engagement can be accepted, including conflicts and communication arrangements.
  3. Agree the scope and price of a consultation or initial assessment before it takes place.
  4. Agree further work, fees, expenses, authority and engagement documents.
  5. Carry out the work, discuss key decisions, report progress and deliver agreed results.

Working across borders

The engagement covers Russian law. Foreign-law questions, translation, certification and the participation of local advisers are agreed as needed. The language of this page does not imply a foreign professional qualification.

Questions before you start

What should I do about an unpaid contract?

Summarise the agreement, what was delivered and the payment deadline. Relevant documents can then be requested through an agreed channel.

Can you defend a claim against us?

Yes. The response is assessed with the procedural stage and deadline in mind.

Can a foreign judgment be used?

Its potential recognition and enforcement in Russia must be assessed individually.

What if enforcement has already begun?

Describe the current stage. The documents and possible further steps are reviewed within a separately agreed scope.
